Terms of Service

These Terms of Service ("Terms") govern your use of the AnimalFace AI website at animalface.xyz (the "Service") operated by AnimalFace AI ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Service.

1. Description of Service

AnimalFace AI provides a free, browser-based AI tool that analyzes uploaded facial photographs and returns a personality-style result indicating whether the user's facial impression aligns with various animal face archetypes (such as dog, cat, dinosaur, bear, or rabbit). The Service is provided for entertainment, personality exploration, and educational purposes only. It is not a medical tool, biometric identification system, psychological assessment service, or scientific measurement instrument of any kind.

The core animal face test is free to use without creating an account. Optional account features, such as saving results, may be added in the future and will be described in updated Terms at that time.

2. Acceptance of Terms

By using the Service, you confirm that:

• You are at least 13 years of age. If you are between 13 and 18 years old, you have parental or guardian consent to use the Service.
• You have read, understood, and agree to these Terms and our Privacy Policy.
• You will use the Service in compliance with all applicable local, national, and international laws and regulations.
• You have the legal right to upload any image you submit to the Service, including the right to the facial image depicted in the photograph.

3. Permitted Use

You may use the Service for personal, non-commercial purposes, including:

• Running the animal face test on your own photos for personal entertainment and curiosity.
• Sharing your test results on social media platforms.
• Using the Service as an icebreaker or group activity with friends and family.
• Referencing or linking to the Service for informational, educational, or entertainment purposes.

4. Prohibited Use

You agree not to use the Service in any of the following ways:

• Unauthorized commercial use: You may not resell, sublicense, or use the Service or its output for any commercial purpose without our prior written consent.
• Non-consensual image use: You may not upload photos of other people without their explicit consent. Uploading identifiable photos of others without permission may violate privacy laws in your jurisdiction.
• Harmful or illegal content: You may not use the Service to process images that depict or promote illegal activities, violence, exploitation, or any other content prohibited by applicable law.
• Automated access: You may not use bots, scrapers, or other automated tools to access the Service in a manner that places excessive load on our infrastructure.
• Reverse engineering: You may not attempt to reverse engineer, decompile, or extract the AI model or any other proprietary component of the Service.
• Misrepresentation: You may not present the Service's output as a medical, scientific, psychological, or biometric assessment. The results are for entertainment purposes only.
• Interference: You may not interfere with or disrupt the integrity or performance of the Service or the data contained therein.

5. Intellectual Property

All content, design, code, branding, and other intellectual property associated with the Service — including but not limited to the AnimalFace AI name, logo, website design, text content, trained AI model, and underlying software — is owned by or licensed to AnimalFace AI and is protected by applicable copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, republish, upload, post, transmit, or distribute any part of the Service's content without our prior written permission, except as expressly permitted by these Terms or applicable law.

The underlying TensorFlow.js framework and Teachable Machine platform used by the Service are developed by Google and subject to their respective open-source licenses. Use of those components within the Service is governed by those licenses.

6. Content You Upload

When you upload a photo to use the animal face test, you represent and warrant that:

• You own the photo or have explicit permission to use it for this purpose.
• The photo does not violate any third party's rights, including copyright, privacy, or publicity rights.
• You understand that the photo is processed entirely locally in your browser and is not transmitted to or stored by our Service.

Because all image processing occurs locally in your browser, we do not receive, access, or store any images you upload. You retain full ownership of your photos at all times.

7. User Accounts

If you create an account with AnimalFace AI, you are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that are used for fraudulent, abusive, or illegal purposes.

8. Third-Party Services

The Service integrates with third-party services including Google Analytics, Google AdSense, Supabase, Microsoft Clarity, Userback, and Formspree. Your use of the Service may result in interactions with these third-party services, which have their own terms of service and privacy policies. We are not responsible for the practices of any third-party service providers. We encourage you to review the privacy policies of these services.

The Service may contain links to third-party websites or resources. These links are provided for convenience only. We do not endorse and are not responsible for the content, products, or services on or available from those websites.

9. Advertising

AnimalFace AI displays advertisements through Google AdSense. These advertisements help support the free operation of the Service. By using the Service, you acknowledge that advertisements may be displayed. Google AdSense may use cookies to show personalized ads based on your interests and browsing behavior. You can manage ad personalization through Google's ad settings. We are not responsible for the content of third-party advertisements displayed on the Service.

10. Disclaimers and Limitation of Liability

Entertainment Purpose Only: The animal face test and all results generated by the Service are provided for entertainment and personality exploration purposes only. The results do not constitute and should not be interpreted as medical advice, psychological assessment, biometric identification, scientific measurement, or any other form of professional assessment. Do not make important personal, professional, or health-related decisions based on the results of this test.

"As Is" Basis: The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Accuracy: We do not warrant that the AI model's results will be accurate, consistent, or appropriate for any particular purpose. The results are probabilistic outputs of a trained machine learning model and may vary based on photo quality, lighting, expression, and other factors.

Limitation of Liability: To the fullest extent permitted by applicable law, AnimalFace AI and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or any personal harm, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim (which, as the core Service is free, is typically zero).

11. Indemnification

You agree to indemnify, defend, and hold harmless AnimalFace AI and its operators from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including but not limited to your uploading of any content that violates third-party rights.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. You may stop using the Service at any time. If you have an account, you may request deletion of your account by contacting us at the email below.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction for violations of intellectual property rights.

You agree that any arbitration or legal proceedings shall be conducted on an individual basis and not as part of any class, consolidated, or representative action.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.
